Terms of Use
Last Updated: August 31, 2026
The website www.evercut.ai and the services, features, tools, content, and functionality made available through EverCut (collectively, the “Services”) are owned and operated by PearlMountain Limited, a company registered in Hong Kong (“PearlMountain,” “we,” “us,” or “our”).
These Terms of Use (“Terms”) govern your access to and use of the Services. Please read these Terms carefully before accessing or using EverCut. By creating an account, purchasing or subscribing to the Services, accessing or using the Services, or otherwise indicating your acceptance of these Terms, you agree to be bound by these Terms and any policies or additional terms incorporated herein by reference (collectively, the “Agreement”).
If you do not agree to this Agreement, you must not access or use the Services.
1. Agreement
By entering into this Agreement, you represent and warrant that you have the legal capacity to enter into a binding agreement under the laws applicable to you.
You must be at least 13 years of age to use the Services. If you have not reached the age of legal majority in your jurisdiction, you may use the Services only with the consent and under the supervision of a parent or legal guardian where required by applicable law.
If you access or use the Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to this Agreement. In such circumstances, references to “you” and “your” include that entity.
Our Privacy Policy, Cookie Policy, and any additional policies, rules, or terms expressly referenced in these Terms or made applicable to particular features of the Services are incorporated into this Agreement by reference.
PearlMountain may establish or modify reasonable procedures, policies, technical requirements, usage limitations, and guidelines relating to the Services. Certain features or functionality may be subject to additional terms disclosed in connection with the relevant feature.
The availability of the Services, features, plans, and functionality may vary depending on your location, account status, subscription plan, or other applicable conditions. PearlMountain may add, modify, suspend, restrict, replace, or discontinue any part of the Services from time to time.
You are responsible for ensuring that your access to and use of the Services complies with all laws and regulations applicable to you, including any applicable trade, export control, or sanctions requirements.
Notices and communications concerning your account, subscription, transactions, security, the Services, or this Agreement may be provided electronically, including by email or through notices made available within the Services. To the extent permitted by applicable law, such electronic communications satisfy any requirement that communications be provided in writing.
2. Registration and Account
Certain features of the Services may require you to create an EverCut account.
When registering for or using an account, you agree to provide information that is accurate, current, and complete and to keep such information reasonably up to date.
You are responsible for maintaining the confidentiality and security of your account credentials and for activities conducted through your account. You must not permit unauthorized access to or use of your account.
If you become aware of or reasonably suspect unauthorized access to or use of your account, you should promptly take reasonable measures to secure your account and notify us.
You may not create or use an account using false, fabricated, misleading, or deceptive information, impersonate another person or entity, misrepresent your affiliation with another person or entity, or use an account for fraudulent, unlawful, or abusive purposes.
We reserve the right to refuse registration or restrict, suspend, or terminate an account where we reasonably believe that the account is being used in violation of this Agreement or applicable law, or where such action is reasonably necessary to protect the security or integrity of the Services.
Personal information collected in connection with your account will be handled in accordance with our Privacy Policy.
3. Subscriptions, Pricing and Payment
EverCut may offer both free and paid Services. The features, functionality, usage limits, storage, and other benefits applicable to each plan will be described on the relevant pricing or purchase page.
Paid Services may be offered on a monthly or annual recurring subscription basis.
By purchasing a recurring subscription, you authorize PearlMountain and its applicable payment service providers to charge the subscription fees and applicable taxes to your selected payment method for each subscription period until the subscription is cancelled.
Unless otherwise stated at the time of purchase, subscriptions will automatically renew for successive periods corresponding to the subscription term selected by you.
3.1 Cancellation
You may cancel your subscription at any time. To avoid being charged for the next subscription period, a cancellation request must be made at least 48 hours before the applicable renewal date.
If a cancellation request is made within 48 hours of the renewal date, the applicable payment method may already be processed or charged for the next subscription period.
Following cancellation, you may continue to use the applicable paid Services until the end of the subscription period for which payment has already been made, unless otherwise stated or required by applicable law.
3.2 Refund Policy
EverCut provides a 7-day money-back guarantee for the first payment of a subscription period.
If you are not satisfied with the Services, you may request a refund within seven (7) days from the date of your first applicable subscription payment.
The 7-day money-back guarantee applies only to the first payment of the applicable subscription period and does not apply to subsequent renewal payments.
PearlMountain reserves the right to decline a refund request where there is reasonable evidence of fraud, abuse, unlawful activity, manipulation of the refund policy, or other material violation of this Agreement.
Nothing in these Terms limits any rights or remedies available to you under applicable law that cannot be excluded or limited.
3.3 Pricing and Payment
Prices, subscription plans, promotions, and special offers may be changed from time to time. Any change to the price of an existing recurring subscription will take effect in accordance with applicable law and any notice required to be provided to you.
Unless otherwise stated, fees do not include applicable taxes, duties, levies, or similar governmental charges, which may be added where required by law.
Payment transactions may be processed by third-party payment service providers. You represent and warrant that you are authorized to use the payment method submitted in connection with a transaction and are responsible for maintaining a valid payment method.
If a payment cannot be successfully processed, we may suspend or restrict access to the applicable paid Services until payment has been successfully completed.
We may refuse or cancel transactions where we reasonably suspect fraud, unauthorized use, payment failure, or other unlawful activity.
4. Acceptable Use
You may use the Services only for lawful purposes and in accordance with this Agreement.
You must not use the Services to upload, submit, process, generate, store, or otherwise make available content, or engage in conduct, that:
- violates applicable law or regulation;
- infringes or misappropriates any copyright, trademark, patent, trade secret, privacy right, publicity right, or other right of any person or entity;
- is fraudulent, deceptive, defamatory, threatening, harassing, or unlawfully discriminatory;
- sexually exploits or otherwise harms minors;

- contains unlawful pornographic or sexually exploitative material;
- unlawfully promotes hatred, violence, or discrimination;
- impersonates another person or entity or materially misrepresents an identity or affiliation;

- facilitates phishing, credential theft, fraud, spam, or other deceptive or abusive activity; or
- otherwise violates this Agreement or any policy applicable to the Services.
You must not:
- gain or attempt to gain unauthorized access to the Services, another user's account, or systems or networks connected to the Services;
- probe, scan, or test vulnerabilities or circumvent security, authentication, access, usage, subscription, rate, or other technical restrictions;
- interfere with, disrupt, overload, damage, or impair the normal operation of the Services;
- use bots, spiders, crawlers, scrapers, automated extraction tools, or similar means to access, collect, extract, reproduce, or download information or content from the Services except where expressly authorized;
- reverse engineer, decompile, disassemble, decode, or otherwise attempt to derive source code, underlying models, algorithms, systems, or non-public technology of the Services, except to the extent such restriction is prohibited by applicable law;
- reproduce, resell, sublicense, distribute, or otherwise commercially exploit the Services except as expressly permitted;
- use the Services or any content made available through them to create, train, develop, or operate a competing product or service through unauthorized extraction, copying, or reproduction; or
- use the Services in a manner that materially harms PearlMountain, other users, service providers, or third parties.
PearlMountain may investigate suspected violations and take appropriate action, including removing or restricting content and restricting, suspending, or terminating access to the Services.
5. User Content
“User Content” means videos, images, audio, text, prompts, instructions, and other materials that you upload, submit, provide, create, or process through the Services.
5.1 Ownership
As between you and PearlMountain, you retain the rights that you hold in your User Content. Nothing in this Agreement transfers ownership of your User Content to PearlMountain.
5.2 User Content License
You grant PearlMountain a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, modify, adapt, transmit, and otherwise use User Content solely to the extent reasonably necessary to provide, operate, maintain, secure, and support the Services, perform functionality requested by you, comply with applicable law, and enforce this Agreement.
This license does not grant PearlMountain an independent right to commercially exploit your User Content.
5.3 Your Responsibilities
You represent and warrant that:
- you own your User Content or have all rights, licenses, permissions, consents, and authority necessary to submit and process it through the Services;
- your User Content and its processing in accordance with your instructions will not infringe or violate third-party rights;
- you have obtained any permissions or lawful authority required where User Content contains personal information, images, voices, likenesses, trademarks, or other protected material relating to third parties; and
- your User Content complies with this Agreement and applicable law.
You are responsible for your User Content and for determining whether your use of such content through the Services is lawful and appropriate.
5.4 Processing and Storage
PearlMountain may perform technical processing reasonably necessary to provide the Services, including uploading, encoding, transcoding, analyzing, modifying, generating, rendering, storing, or transmitting User Content.
Certain functionality may require User Content to be processed by third-party service providers as described in this Agreement and our Privacy Policy.
PearlMountain does not use User Content submitted through EverCut to train, fine-tune, develop, or improve its own generalized artificial intelligence or machine learning models.
The Services are not intended to constitute a permanent backup or archival service. You are responsible for maintaining appropriate backup copies of User Content and completed content that you wish to preserve.
5.5 Feedback
If you provide suggestions, ideas, comments, feedback, or other recommendations concerning EverCut or the Services (“Feedback”), you grant PearlMountain the right to use such Feedback for the purpose of developing, improving, operating, and promoting the Services without restriction or obligation to compensate you, provided that such use does not identify you publicly without your permission.
6. AI-Powered Features
Certain features of EverCut use artificial intelligence, machine learning, or other automated technologies (“AI Features”).
You may provide text, images, video, audio, prompts, instructions, or other content to AI Features (“Input”) and receive content generated, edited, transformed, or otherwise produced through such features (“Output”).
6.1 Input and Output
You are responsible for your Input and must ensure that you have all rights and permissions necessary to submit and process it through the Services.
Subject to applicable law and any third-party rights, PearlMountain does not claim ownership of Output generated specifically for you through your use of the Services.
You are responsible for reviewing Output and determining whether it is appropriate and lawful for your intended use.
6.2 Nature of AI Output
Artificial intelligence and machine learning technologies are probabilistic. Output may therefore be inaccurate, incomplete, misleading, unexpected, offensive, or otherwise unsuitable for your intended purpose.
PearlMountain does not represent or warrant that Output will be accurate, complete, reliable, error-free, or suitable for any particular purpose.
Output may not be unique. Other users may receive identical or similar output through EverCut or other services.
You should independently review and, where appropriate, verify Output before relying on, publishing, distributing, or otherwise using it.
6.3 Intellectual Property Considerations
PearlMountain does not represent or warrant that Output is eligible for copyright, trademark, patent, or other intellectual property protection or that its use will not infringe or otherwise conflict with third-party rights.
You are responsible for determining and obtaining any rights, permissions, licenses, or clearances necessary for your intended use of Output.
6.4 Third-Party AI Technologies
Certain AI Features may rely on models, APIs, infrastructure, or other technologies supplied by third-party service providers. Input and other information reasonably necessary to provide the requested functionality may therefore be processed by such providers.
The availability, performance, limitations, and processing of third-party AI technologies may be subject to the terms, policies, technical requirements, and availability of the relevant providers.
PearlMountain may add, replace, or discontinue underlying third-party technologies where reasonably necessary to operate, maintain, or improve the Services.
7. Ownership and License
Except for User Content and third-party materials, the Services and the software, technology, interfaces, designs, graphics, logos, trademarks, service marks, text, documentation, databases, and other content made available by PearlMountain through EverCut (“PearlMountain Content”) are owned by or licensed to PearlMountain and are protected by applicable intellectual property laws.
Subject to your compliance with this Agreement, PearlMountain grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable right to access and use the Services for their intended purposes during the period in which you are authorized to use them.
Except as expressly permitted under this Agreement or applicable law, you may not copy, reproduce, modify, adapt, distribute, sell, license, publish, display, create derivative works from, reverse engineer, or otherwise exploit PearlMountain Content or the Services.
Nothing in this Agreement transfers any ownership interest in the Services or PearlMountain Content to you. All rights not expressly granted are reserved by PearlMountain and its licensors.
“EverCut,” PearlMountain's names, logos, product names, and related marks may not be used without applicable authorization.
8. Third-Party Services
EverCut may provide access to or integrate content, services, APIs, technologies, or other resources supplied by third parties.
These may include stock photos, videos, graphics, GIFs, stickers, and other media supplied through third-party content providers, including Pexels, Unsplash, Pixabay, and Klipy.
Third-party content remains subject to the intellectual property rights of its respective owners and to the licenses, terms, restrictions, and usage requirements imposed by the applicable provider.
Your ability to access third-party content through EverCut does not mean that PearlMountain owns such content or grants you rights beyond those made available under the applicable third-party license.
You are responsible for reviewing and complying with any applicable third-party license or usage restrictions before using, publishing, distributing, or commercially exploiting third-party content.
Depending on the applicable provider and content, restrictions may apply to matters such as:
- redistribution or sale of content on a standalone basis;
- use of content as or within trademarks, logos, or service marks;
- use involving identifiable persons, brands, or other protected subject matter;
- use that implies endorsement, sponsorship, or affiliation;
- unlawful, defamatory, misleading, offensive, or otherwise restricted uses; and
- other uses restricted by the applicable provider's license or terms.
PearlMountain does not grant any independent license to third-party content and does not represent or warrant that third-party content is suitable or legally cleared for every intended use.
Third-party services and technologies may also be governed by their own terms, privacy policies, licenses, and availability requirements. PearlMountain does not control the independent acts, services, availability, content, or practices of third-party providers.
The inclusion or integration of third-party content or services within EverCut does not constitute an endorsement or warranty by PearlMountain regarding such third party.
9. Copyright Infringement Notices
PearlMountain respects the intellectual property rights of others and expects users of EverCut to do the same.
If you believe that content processed or made available through EverCut infringes your copyright or other intellectual property rights, you may submit a notice to [email protected]
Your notice should include information reasonably sufficient for us to evaluate the claim, including:
- identification of the copyrighted work or other intellectual property claimed to have been infringed;
- identification of the allegedly infringing material and information reasonably sufficient to locate it;
- your name and contact information;
- a statement that you have a good-faith belief that the disputed use is not authorized by the rights holder, its agent, or applicable law;
- a statement that the information contained in the notice is accurate and that you are the rights holder or authorized to act on behalf of the rights holder; and
- your physical or electronic signature.
We may remove, restrict, or disable access to content where we reasonably determine that doing so is appropriate or required by applicable law.
Where appropriate, PearlMountain may notify the affected user and consider any valid response or counter-notice submitted in accordance with applicable law.
We reserve the right to restrict, suspend, or terminate accounts of users who repeatedly or materially infringe intellectual property rights.
10. Suspension and Termination
You may discontinue use of the Services at any time. Cancellation of a paid subscription does not by itself delete your EverCut account.
You may request deletion of your account through the methods made available by EverCut or by contacting [email protected]. Account deletion may result in permanent loss of User Content, projects, Output, and other data associated with the account. You are responsible for retaining any content you wish to preserve before requesting deletion.
PearlMountain may restrict, suspend, or terminate access to all or part of the Services where we reasonably determine that:
- you have materially or repeatedly violated this Agreement or applicable law;
- your use creates or may create a security, legal, or operational risk;
- your account is associated with fraudulent, abusive, or unauthorized activity;
- payment obligations remain unpaid;
- continued provision of the Services is prohibited by law or governmental requirement; or
- such action is reasonably necessary to protect PearlMountain, the Services, other users, or third parties.
Where reasonably practicable and appropriate, we may provide notice before termination. We may act without prior notice where immediate action is reasonably necessary for legal, security, fraud-prevention, or platform-integrity purposes.
Upon termination, your right to use the affected Services will cease. Termination does not affect payment obligations or other rights and obligations accrued before termination.
Personal information and User Content associated with account deletion or termination will be handled in accordance with our Privacy Policy and applicable legal obligations.
Provisions that by their nature should survive termination, including those concerning intellectual property, payment obligations, indemnification, disclaimers, limitation of liability, and dispute resolution, will survive termination.
11. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless PearlMountain, its affiliates, licensors, service providers, and their respective officers, directors, employees, contractors, and agents from and against claims, liabilities, damages, losses, judgments, costs, and expenses, including reasonable legal fees, arising out of or relating to:
- your access to or use of the Services
- your User Content, Input, or use of Output
- your breach of this Agreement
- your violation of applicable law
- your infringement or violation of the intellectual property, privacy, publicity, or other rights of any third party
PearlMountain may assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate reasonably with such defense.
12. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES, INCLUDING AI FEATURES, THIRD-PARTY CONTENT, AND THIRD-PARTY SERVICES MADE AVAILABLE THROUGH EVERCUT, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
PEARLMOUNTAIN DISCLAIMS ALL WARRANTIES, REPRESENTATIONS, CONDITIONS, AND GUARANTEES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, PEARLMOUNTAIN DOES NOT WARRANT THAT:
- THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR AVAILABLE AT ALL TIMES;
- DEFECTS OR ERRORS WILL BE CORRECTED;
- THE SERVICES WILL BE FREE OF HARMFUL COMPONENTS;
- USER CONTENT OR DATA WILL NEVER BE LOST;
- AI-GENERATED OR AI-PROCESSED OUTPUT WILL BE ACCURATE, COMPLETE, UNIQUE, RELIABLE, OR SUITABLE FOR ANY PARTICULAR PURPOSE;
- THIRD-PARTY CONTENT WILL BE SUITABLE OR LEGALLY CLEARED FOR EVERY INTENDED USE; OR
- USE OF ANY OUTPUT OR THIRD-PARTY CONTENT WILL NOT INFRINGE OR OTHERWISE AFFECT THIRD-PARTY RIGHTS.
YOU USE THE SERVICES, OUTPUT, AND THIRD-PARTY CONTENT AT YOUR OWN DISCRETION AND RISK.
Nothing in this Agreement excludes warranties, guarantees, or statutory rights that cannot lawfully be excluded.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PEARLMOUNTAIN AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO:
- YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICES;
- USER CONTENT, INPUT, OR OUTPUT;
- THIRD-PARTY CONTENT, SERVICES, OR TECHNOLOGIES;
- LOSS, DELETION, CORRUPTION, OR UNAVAILABILITY OF DATA OR CONTENT;
- UNAUTHORIZED ACCESS TO OR USE OF YOUR ACCOUNT;
- INTERRUPTION, SUSPENSION, MODIFICATION, OR TERMINATION OF THE SERVICES; OR
- ANY OTHER MATTER RELATING TO THE SERVICES OR THIS AGREEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PEARLMOUNTAIN'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THIS AGREEMENT WILL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO PEARLMOUNTAIN FOR THE SERVICES GIVING RISE TO THE CLAIM.
The foregoing exclusions and limitations apply regardless of the legal theory on which liability is based and even if PearlMountain has been advised of the possibility of such damages.
Nothing in this Agreement excludes or limits liability to the extent such liability cannot lawfully be excluded or limited.
14. Governing Law
This Agreement and any dispute, claim, or controversy arising out of or relating to this Agreement or the Services will be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict-of-law principles.
Subject to any rights that cannot lawfully be waived under applicable law, disputes arising out of or relating to this Agreement or the Services will be subject to the jurisdiction of the competent courts of Hong Kong.
Nothing in this section limits any mandatory consumer rights or jurisdictional protections available under applicable law.
15. Miscellaneous
These Terms, together with the Privacy Policy, Cookie Policy, and any additional terms or policies expressly incorporated by reference, constitute the entire agreement between you and PearlMountain concerning the Services and supersede prior agreements, representations, or understandings concerning the same subject matter.
If any provision of this Agreement is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible or severed to the extent necessary, and the remaining provisions will remain in full force and effect.
PearlMountain's failure or delay in exercising or enforcing any right or provision of this Agreement does not constitute a waiver of that right or provision.
You may not assign or transfer your rights or obligations under this Agreement without PearlMountain's prior written consent. PearlMountain may assign or transfer its rights and obligations in connection with a merger, acquisition, corporate reorganization, sale of assets, or otherwise as permitted by applicable law.
Nothing in this Agreement creates any partnership, joint venture, employment, agency, fiduciary, franchise, or similar relationship between you and PearlMountain or between PearlMountain and any third-party service provider.
No user, service provider, contractor, or other third party has authority to create obligations on behalf of PearlMountain unless expressly authorized by PearlMountain in writing.
Sectional headings are provided for convenience only and do not affect the interpretation of this Agreement.
A printed or electronically stored copy of this Agreement and related electronic communications may be used as evidence to the same extent as other business records, subject to applicable law.
16. Changes to This Agreement
PearlMountain may modify the Services from time to time, including by adding, modifying, restricting, replacing, or discontinuing features or functionality.
We may also amend or replace this Agreement to reflect changes to the Services, our business practices, legal or regulatory requirements, security considerations, or other relevant circumstances.
When these Terms are updated, we will revise the “Last Updated” date at the beginning of these Terms.
Where required by applicable law, we will provide reasonable notice of material changes before they become effective.
Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Agreement to the extent permitted by applicable law. If you do not agree to the revised Agreement, you should discontinue use of the Services.
